Synopsis: Captain Jonathan Archer of the Earth Starship Enterprise has been arrested by the Klingon Empire for conspiring with rebels, and he is brought before a tribunal, defended by a Klingon advocate named Kolos.

Klingon Prosecutor Orack calls Duras, son of Toral, as his witness against Archer. Captain Duras was commander of the D-5 Battle Cruiser Vor'Tas, pursuing a ship of refugees from the Klingon Protectorate at Rha'darus, when he found their ship docked with the Enterprise, which disabled the Vor'tas and escaped with the refugees. Duras has since been demoted from captain to second weapons officer serving on the Tae'ghogo Defense Perimeter.

Archer asks his advocate to let him testify, and Kolos convinces the magistrate to allow Archer to give his side of the story. Archer testifies that he answered a distress call from an alien ship, whose life support was failing. The ship came from a colony planet that was annexed several years ago by the Klingon Empire, which stripped the planet of resources and never returned. Running out of food and fuel, the colonists left the planet but their ship broke down weeks before the Enterprise answered the distress call. The Enterprise took the colonists aboard and escaped from the Vor'tas to protect them.

Kolos argues that Archer has aided the Empire in the past, helping to expose a Suliban plot to incite a civil war in the Empire, and later helped rescue the Klingon Raptor SomRaw from the atmosphere of a gas giant. The magistrate finds Archer guilty, but due to Archer's past assistance to the Empire, the sentence of death is commuted, and he is sentenced to life in the dilithium mines on the Rura Penthe penal colony. His advocate is also sent there after Kolos protests the injustice of the sentence.

Subcommander T'Pol knows some Klingon officials from her days in the Ministry of Security, and bribes a corrections officer and a captain of a dilithium barge to help Archer escape from Rura Penthe. Kolos decides to remain there rather than become a fugitive from justice.
